Chris is a partner with 20 years of experience primarily helping creditors exercise and defend their rights and remedies. His practice focuses on representing secured lenders with defaulted loans. His experience includes banking litigation, foreclosures, workouts, restructurings, bankruptcy, insolvency, liquidations, receiverships, and Article 9 transactions. Specific areas of experience include representation of secured lenders and loan servicers with distressed loans or collateral, secured lenders in litigation, including defending lenders against lender-liability lawsuits, landlords involved in bankruptcy and similar cases, trade creditors inside state court and bankruptcy court, including defending creditors against preference and fraudulent-transfer claims, and equipment lessors involved with defaulted leases in and outs bankruptcy.
When Chris is not litigating, his transactional practice centers around negotiating and drafting forbearance agreements, voluntary foreclosure agreements, asset purchase agreements, and loan sale agreements. He has handled hundreds of real estate foreclosures, as wells as foreclosures on personal property. Chris also represents court-appointed receivers in connection with their handling of distressed or insolvent companies, and he has written and spoken extensively on all of these topics.
Quite different from Chris’s regular practice representing creditors and receivers, he also enjoys helping action sports athletes, teams, owners, and sponsors in connection with negotiating and drafting performance and sponsorship contracts. Chris has worked mainly in the professional motocross and supercross industries, having handled several matters for Factory Connection Racing and the Geico Honda Race Team. He has also worked with professional athletes including Christian Craig, Adam Enticknap, and Henry Miller.
